Terms and Conditions of Use

TERMS AND CONDITIONS OF USE

The term "we", "us," and "the Company" refers to UkraineHotel.biz, the Ukrainian Incoming Tour Operator DISCOVER UKRAINE (Kiev, Ukraine), and the term "you" and "the Customer" refers to the customer making a reservation request for hotels in Ukraine (Kiev, Odessa, Yalta, Donensk, Dnepropetrovsk, Kharkiv, Carpathians, Ivano-Frankivsk, Kherson, Lviv, Chernivtsi, Chernigiv, Kamyanets-Podolskiy, Truskavets, Mariupol), transfers, sightseeing tours and visa support through us directly through this website. All reservations you book with us are subject to the following terms and conditions as they exist at the time the reservation is made. We reserve the right to change these terms and conditions in the future.

1. Terms of service

1.1. The cost of your reservation is the total of: the indicated room rate multiplied by the number of days in your reservation, plus an additional amount for the tax recovery charges and our service fees.
1.2. After you make your request of Ukraine hotel room or other travel related services on UkraineHotel.biz we send the confirmation of your Ukraine hotel reservation and the Voucher for check-in at the hotel within 48 hours (2 working days, excluding weekends and national holidays in Ukraine). If the room requested by you is not available at a hotel, then we offer the alternative type of room at the same hotel or a room at another hotel of the similar category. You have a right to reject this offered accommodation within 24 hours at no cost for you.
1.3. If you pay for your reservation by a credit card, you should fill in the form for your credit card details. Than we send you the confirmation of your reservation and the Voucher for check-in at the hotel. The owner of the card must be the principal passenger.
1.4. If you pay by bank transfer, than after you make your reservation request we will send you the confirmation the Agreement about sale and purchase of travel services for Ukraine (by fax or scanned copy by email). The Customer should read it, sign it and then send the signed Agreement to the Company (by fax or scanned copy by email). Then the Comapany sends and the invoice to the Customer that is to be paid by bank transfer. The Voucher for check-in at the hotel is sent only upon the payment by bank transfer is received.
1.5. If you wish to make reservation for someone else you can pay by bank transfer. Please input name and passport number of a person in the form "Clients Info" that you wish to make reservation for.
1.6. You receive the Voucher for hotel accommodation and other chosen and paid services like transfer, sightseeing tours, etc.
1.7. The invitation letter to apply for a visa to the Ukrainian Consulate are sent to provided fax number after full payment is received. Our company as a registered travel company issues a visa support letter for the exact duration of your stay at the hotel in Ukraine. The period of Ukraine visa support can't be longer than the duration of your Ukraine hotel booking.
1.8. Guest names (age of child) should be supplied obligatory to make your room reservation.
1.9. Bed type and smoking preferences are not guaranteed.
1.10. Room pictures may differ from the actual room you receive.
1.11. You must present your passport (and a child's passport) and the Voucher upon check-in at the hotel.
1.12. By proceeding with this reservation, you agree to all terms and conditions.

2. Terms of payment

2.1. Payment by a credit card.
We accept the following credit cards: Visa, MasterCard/EuroCard as well as Visa Electron and Maestro/Cirrus emitted by Raiffeisen Bank Aval (Kiev, Ukraine). Your credit card is charged for payment after confirmation of your Ukraine hotel reservation and your order for transfer, sightseeing tour or Visa Support Letter. Your credit card is debited in USD by DISCOVER UKRAINE (Kiev, Ukraine).
Your credit card will be charged immediately upon confirmation. Your credit card statement will indicate transactions via DISCOVER UKRAINE - the owner of this service. The cost of your order is displayed in Ukrainian local currency - Hrivnas (UAH) and in USD. All online credit card transactions are made through the eCommerceConnect Gateway of Ukrainan Processing Center (Kiev, Ukraine).
2.2. Payment by bank transfer.
2.2.1. The invoice is to be paid for the total cost. The invoice must be paid by bank transfer not later than 3 days after the date of its receiving by e-mail (the date is indicated in the invoice). No prices or hotel availability are guaranteed until full payment is received. The Customer (Remitter) pays all bank charges for funds transfer.
2.2.2. The full amount is the total cost of your reservation includes accommodation cost, tax charges and our service fees.
2.2.3. The Company reserves the right to cancel your room reservation order the Compan y does not receive the payments according to invoice within 7 days after the date of its issuing (the date is indicated in the invoice).

3. Cancellation or changes

3.1. Bookings are subject to USD 10 cancellation fee for any CANCELLATION/CHANGE that occurs within the term from the date of confirmation of reservation till 72 hours prior to arrival date. In this case the amount charged from your credit card will be refunded to your credit card excluding USD 10 cancellation fee within next 10 working days.
Bookings are subject to a one-night room charge for any CANCELLATION/CHANGE that occurs within the term from 0 till 72 hours prior to arrival date. In this case your credit card will be charged for one-night room charge and the rest amount will be refunded to your credit card within next 10 working days.
3.2. The Cancellation Policy for Carpathians hotels is different then stipulated in point 3.1. Please read about terms of cancellation in hotel info for each hotel in Carpathians.
3.3. The arrival time is determined as 12.00 on the arrival date by Ukrainian local time.
3.4. If you wish to change your Ukraine hotel reservation for another date or another hotel we recommend you at first to make new room reservation for new date or for new hotel and than make cancellation of your previous order.
3.5. You agree to pay any cancellation or change fee that you incur. In some cases, we are unable to permit changes to or cancellations of reservations after they are made, generally for stays during holiday periods or special events taking place in Ukraine (Kiev, Odessa, Yalta, Donensk, Dnepropetrovsk, Kharkiv, Carpathians, Ivano-Frankivsk, Kherson, Lviv, Chernivtsi, Chernigiv, Kamyanets-Podolskiy, Truskavets, Mariupol). You will be notified before the reservation order is completed if a reservation is non refundable or non changeable. You agree to abide by the terms and conditions imposed with respect to any completed reservation order for a hotel stay as specified on the reservation order form.
3.6. The fee for Ukraine visa support letter is non refundable and subject to 100% cancellation charge.
3.7. If the cancellation/change of transfer or sightseeing tour in Kiev, Odessa, Yalta, Donensk, Dnepropetrovsk, Kharkiv, Carpathians, Ivano-Frankivsk, Kherson, Lviv, Chernivtsi, Chernigiv, Kamyanets-Podolskiy, Truskavets, Mariupol is made within the term from the date of confirmation of reservation till 72 hours prior to the date when these services will be used, then USD 10 cancellation fee is charged. In this case the amount charged from your credit card will be refunded to your credit card excluding USD 10 cancellation fee within next 10 working days.
If the cancellation/change of transfer or sightseeing tour is made less then 72 hours prior the date when these services will be used, then the cost of these services is not refundable and subject to 100% cancellation charge.
3.8. The cancellation policy for group reservation (for 10 persons and more) differs from the cancellation policy for individuals. The cancellation terms are specified for each Ukraine hotel booked. The details of cancellation terms will be sent to you with a confirmation for your group reservation.
3.9. The Customer is obliged to make all notifications about any CANCELLATION/CHANGE to the Company in writing on the Cancellation page or by email or by fax +380 44 4564699. The reservation cancellation request will be transmitted to the hotel for immediate processing. The confirmation of your cancelled reservation will be sent to your email address.

4. Room rates

4.1. Our hotel rates for hotels in Kiev, Odessa, Yalta, Donensk, Dnepropetrovsk, Kharkiv, Carpathians, Ivano-Frankivsk, Kherson, Lviv, Chernivtsi, Chernigiv, Kamyanets-Podolskiy, Truskavets, Mariupol are only available through our web-site and can not be obtained at the hotel directly, as they will not have our discounted rates in their system.
4.2. Rates are quoted in US dollars per room per night. Usually rates include breakfast. If breakfast is not included it is indicated in hotel details. The rate you selected does not include any applicable service fees, charges for optional incidentals (such as mini bar snacks or telephone calls), or regulatory surcharges. The lodging will assess these fees, charges, and surcharges upon check-out.
4.3. The Company attempts to secure the best hotel rates available. The Company's guarantee provides limited assurance that our rates are the lowest rates available. It is rare when we are able to provide you only with rack room rates or above for some Ukraine hotels without any discounts from rack rates in accordance with the hotel policy.
4.4. Rates include tax charges, hotel fee and our services fee.
4.5. Room rates can rise for days of special events (exhibitions, fairs, festivals, etc.), taking place in Ukraine (Kiev, Odessa, Yalta, Donensk, Dnepropetrovsk, Kharkiv, Carpathians, Ivano-Frankivsk, Kherson, Lviv, Chernivtsi, Chernigiv, Kamyanets-Podolskiy, Truskavets, Mariupol). You will be informed about rates and cancellation policy for this period when you make your reservation.
4.6. In case when you book double room for one person or we offer you double room for one person as alternative of single room, the rate for double room is charged.

5. Warranties and liabilities of the Parties

5.1. You warrant that you are at least 18 years old and possess the legal authority to use this website in accordance with the terms and conditions. You agree to be financially responsible for all of your use of this website as well as for the use of your name and your banking account to pay for products and services purchased at this website by members of your household, including minors living with you. You also warrant that all information supplied by you or members of your household in using this website are true and accurate.
5.2. You communicate with the Company electronically whenever you visit UkraineHotel.biz or send emails to us. You consent to receive communications from the Company electronically and by fax. You agree that all notices, disclosures, agreements and other communications that we provide to you electronically or by fax satisfy any legal requirements that communications be in writing.
5.3. The Company is responsible for guaranteed reservation of the ordered accommodation and additional services according to your order that is fully paid in advance.
5.4. The Company UkraineHotel.biz does not take any responsibility for the standards of the hotel accommodation or the service provided by the hotel.
5.5. Neither of parties shall be liable to the other for any delay or failure in performance under these Terms and Conditions resulting directly or indirectly from force majeure circumstances: acts of nature, fires, floods, earthquakes or military operations or causes beyond their reasonable control.
5.6. The Company and the Customer are released from mutual liability, fully or partially, in the case of which hinder the performance of the contractual obligations.
5.7. The Company is not liable in the following cases:
- If the Consulate rejects or delay issue of Ukraine visa for the Customer as well as financial and moral losses arising in connection with this.
- If the Customer coming late for the flight, train or coach departure.
- for the delay in arrival of the Customer's flight, train or coach and as a result unused services (transfer, excursion program, etc). In such cases the cost of unused services or hotel accommodation is not refunded.
- If the Customer provided inaccurate data (email address, fax number where the visa support letter to be faxed to, first names, last names, passport numbers, passport expiry date, arrival or departure flight or train numbers and dates, children's ages, required time or date for sightseeing tour, etc.) and as result unused services or changes in the tour program. In such cases the cost of unused services is not refunded.
- For cancellation or changes in flight, train or coach schedule and as a result unused services or changes in the tour program. In such cases the cost of unused services is not refunded.
- For the Customer passage through the border custom examination.
- For damage done by the customer to a third party.
- For safe keeping of the customer's luggage during the travel.
- For services booked by the Customer through other agencies and being a part of the tour program.
- For additional services provided by a hotel (telephone calls, mini bar, etc.) and paid by the Customer when check-out at the hotel.

6. Contract

We will treat your reservation order as an offer to make a business contract between us, which shall enter into force upon our confirmation of your reservation order.

We do not own or control the content of those websites and are not responsible for their content or your use of them. We do not endorse the content of any of those websites.

We stayed at the Ukraine hotel for three days in March, 2007. The service was excellent and the rooms were cozy. The location was perfect - right next to a metro station. The view of Nezaleznist Square from our room was fantastic.
